A Civil Society and Intellectual Consultation on Manipur (Hill Area) Autonomous District Council (3rd Amendment) Bill 2008 was jointly organized by All India Confederation of SC/ST Organization (www.scstconfederation.net), All India Christian Council (www.indianchristians.in) and North East Support Centre & Helpline (www.nehelpline.net) at New Delhi on June 28, 2010. The consultation was attended by various representatives of different communities of Manipur.
The consultation was chaired by Rev. Paothang Haokip of All India Christian Council. Panelists were K.B Saxena, Professor, Social Justice and Governance, Council for Social Development, Vidya Bushan Rawat, Writer, Researcher and Human Rights Activist and Dr. John Dayal, member of National Integration Council.
The main objectives of the consultation was to look into Manipur (Hill Area) ADC (3rd Amendment) Bill 2008 constitutionally and comparatively with other Autonomous Council bills in different parts of India and secondly, to motivate and encourage the civil society and intellectual forum of Manipur state to debate and consult on the bill collectively and constructively with suggestions and recommendations to decision making bodies for better law enforcement and governance.
The consultation led by panelists has observed some loopholes in Bill, 1971 as well as 3rd Amendment Bill, 2008, that will require further discussion and consultation among different communities along with Government's decision making bodies to bring the changes in order to suit under the constitutional provision for the concern communities.
The consultation observes the following:
1. The consultation observes that Manipur (Hill Area) District Council Bill 1971 was passed by the parliament a year before statehood was given to Manipur. It also observes that the Autonomous District Council under 6th Scheduled of Indian constitution is not to be misunderstood as the power given to Hill Areas or Tribal Areas to bring any harm to constitutional system of the state or the country but it is to protect the rights of tribals, their land and culture.
2. The consultation also observes that the demand for Autonomous District Council Bill, must not mix up with any other issues.
3. The consultation observes that the content of Manipur (Hill Area) Autonomous District Council (3rd Amendment) Bill 2008 were framed in such a way that it looks similar to many provisions under 6th Scheduled of Indian Constitution but the provisions are not the same and not there.
4. The consultation observes that there is a need for further discussion and consultation collectively and constructively with suggestions and recommendations to decision making bodies for better law enforcement and governance.
The final report of the consultation will be available for submission to Manipur Government for the purpose of reference.
