'Ousted' MLA Henry sends legal notice to Govt

Wangkhei AC former MLA Okram Henry has sent a legal notice to the government authorities, cautioning of a contempt petition if incumbent Wangkhei AC MLA Yumkham Erabot is allowed to withdraw any monetary/financial benefits including salary, MLA local area develop-ment fund, any other benefits involving financial benefits including distribution of food grains, fair price shops, etc., by CAF&PD, in the light of an interim order (06/05/2021) passed by the Supreme Court of India in Civil Appeal No.1666 of 2021, filed by the ex-MLA.
The legal notice was sent by O Henry through his counsel advocate Thokchom Deepak to the Chief Secretary, Director General of Police (DGP), Commissioner (CAF&PD), Manipur Legislative Assembly secretary, Imphal East Deputy Commissioner, Imphal West Deputy Commissioner, SP Imphal East and SP Imphal West on Friday.
According to the legal notice, as per the interim order passed by the Supreme Court on May 6, Y Erabot Singh, who was sworn-in as Wangkhei AC MLA on April 21, is not entitled to draw any monetary/financial benefits in respect of the office of Member of the As-sembly, including salary, MLA-LADF, any other benefits involving financial benefits including distribution of food grains and fair price shops under CAF&PD.
Citing the interim order, the legal notice further stated that Erabot Singh is entitled to represent the electorates in the House and participate in the debates.
However, he cannot cast any vote on the floor of the House or in any committee of the House.
He is also not entitled to draw any monetary benefits in respect of the office of Member of the Assembly.
If any of the aforementioned respondents authorise any monetary benefits to Yumkham Erabot Singh, it will amount to willful violation/disobedience of the order/directions of the interim order of the Supreme Court and as such, contempt petitions will be filed against all of them, the notice cautioned.
