Supreme Court Hearing on EEVFAM case on July 5 2018
5th July 2018 , New Delhi
The Special Bench consisting of Justice Madan B. Lukur and Justice U.U. Lalitheard the EEVFAM case at court no 3 of the Supreme Court of India today. After hearing the counsels of all the parties concerned, the Court passed an elaborate order covering five points:
1. The CBI SIT shall complete the investigation of the four incidents that they have already concluded investigation but are pending in the some office as per the CBI manual.
2. From now on, the three investigating officers of the NHRC who have been involving with the investigation shall be deemed to be full member of the SIT and shall be privy to all the documents pertaining to the investigation. When the NHRC pleaded that they are short staffed and will have difficultiesif three of their investigator are assigned to the SIT, Justice Lukur told their counsel that you are an autonomous and powerful organization mandated to protect human right of the people of this country. He also pointed out that what is stake is not just another human rights violation. It has resulted into dead of the person and also in large number. NHRC has to take this a top priority.
3. The Additional Solicitor General (ASG) is directed to advice the Central Government to ensure that, when the services of the three investigators are made available to the SIT, the work of the NHRC is not hampered in any way by providing adequate support and assistance to the NHRC.
4. The CBI shall prepare a list of all the cases that have been originally submitted by the petitioners but have been weeded out by the CBI for some reason in the process of investigation and make it available to the petitioners before the next hearing.
5. The Central Government should file its written response on the miscellaneous application filed by Head Constable Th. Herojit to the Court on 5 January 2018.
The judge also lamented, if their suggestion to set up a state human rights commission has taken with any seriousness or have been simply ignored.
The next date of hearing is fixed on 27 July 2018.
