Resolutions adopted by the participants/ assembled
in the discussion on Human Rights Issues in Encounter Deaths
organized by the Manipur Human Rights Commission,
Human Rights Initiative and
All Manipur Bar Association
in observance of the Human Rights Day
on the 10 December 2009
at the State Guest House, Imphal
Guided by the principles of the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights and other legal instruments
Realising the seriousness of the human rights situation that has been prevailing in Manipur over last few decades
and
Acknowledging the need of the urgent initiative for preventing gross human rights violations all the participants of this discussion have unanimously agreed in adopting this resolution
That, the following recommendations be sent to the authority concerned, and be engaged by the volunteer groups in order to deliver the recommendations;
Short Term
- Implement effectively of supreme court guidelines (DK Basu v/s Govt. of India 1997) and Procedure /Guidelines of the NHRC in investigating, conducting post mortem/autopsy and other forensic/ballistic examinations; check the destruction of evidence of the encounter deaths/extrajudicial executions due to improper deposition of the dead bodies in the Regional Institute of Medical Sciences (RIMS) mortuary, the autopsy the procedure that is noncompliance with the custodial killings, quick disposed off the body, non conduction of forensic examination, etc.
- Strengthen free legal services and counseling/educating victim families and general people by the MHRC, lawyers community, human rights defenders and other civil society groups.
- Proper human rights training and psychological input be imparted to the army, paramilitary forces and police.
- Take actions/mechanisms to build a durable peace by resolving the existing armed conflict in Manipur and (other North East region) by addressing the root causes and make transparent and accountable Confidence Building Measures; the Government of India and State Government of Manipur should repeal the AFSPA start demilitarize the region and initiate democratic mechanisms and other political effort creating an avenue of the participation of the civil society concerned in the process.
