PIL on Article VIII (3) of the Merger Agreement 1949

A PIL Bearing No. 1001 of 2013 at the Hon’ble Supreme Court was filed by Dr. Th. Suresh Singh, Retd. Director of Health Services, Manipur on the 10th Sept. 2013. The Hon’ble Apex Court was kind enough to hear the same on 17th Dec. 2013. The prayer was implementation of Article VIII (3) of the Merger Agreement signed between Maharaja Bodhachandra and the Indian Dominion on 21st Sept. 1949.
This particular clause stated that “The govt. of India also undertake to make suitable provisions for the employment of Manipuris in the various branches of the public services, and in every way encourage Manipuris to join them. They also undertake to preserve various laws, customs and conventions prevailing in the State pertaining to the social, economic and religious life of the people”
The matter was heard at the Apex Court on the 17th Dec. 2013 in a double bench consisting of Justice B.S. Chouhan and Justice S.A. Bobbe. The bench was kind enough to hear patently the case and observed that it is an important one and deserve further hearing as it involves Merger Agreement. It also observe that many State were also merged into India. Hence, the bench directed the petitioner to first approach the State High Court and take their opinion. It further directed the petitioner to come to the Apex Court after completing due process at the State High Court.
Further, detailed judgment is awaited. Meanwhile the petitioner and the Bharatiya Janata Party Manipur Pradesh will prepare to file the case at Manipur High Court as directed by the Hon’ble Supreme Court. At the Supreme Court, the case was represented by Mrs. Pinky Anand, Senior Advocate Supreme Court (LLM Havard).
