Final hearing on Commissioner Imocha's case fixed

The last hearing of the petition against the suspension order of Y Imocha, Commissioner, IFCD has been fixed on February 27 next by an interim order of the Central Administrative Tribunal (CAT), Gauhati bench.
The order issued by the CAT further states that the suspension order of Commissioner Y Imocha by the Manipur government should not be binding until further order.
The interim order of CAT, Gauhati bench was issued on January 25th last, after Y Imocha made a written complaint against the Chief Secretary DS Poonia and the Secretary of the Union Ministry of Personal and Reforms Department.
According to reliable source the suspension order of Commissioner Y Imocha was issued by the Under Secretary of the Department of Personal, GoM, Yumnam Robita on December 9, 2011 for furnishing a written application to the Gauhati High Court claiming that the Muster Roll employees of IFCD will be upgraded to Work Charge, without the knowledge of the State government.
During the suspension period H Imocha was also prohibited from leaving the station.
According to written complaint filed by Commissioner Imocha, the suspension order issued to him is against the All India services Discipline and Appeal Rule 1969.There was no assurance made to the Gauhati High Court that the Muster Roll employees of IFCD will be upgraded to Work Charge, but it was mentioned that process is being carried out to upgrade the Muster Roll employees to Work Charge.
The written complaint further stated that there is a contempt case regarding the issue of the Muster Roll employees.
There has also been an instance where the IFCD Minister ordered for converting the Muster Roll employees to Work Charge and his Private Secretary also mentions the same in the OU submitted.
Accordingly the Commissioner furnished the said information to the Gauhati High Court.
Since the Commissioner never made any assurance to upgrade the Muster Roll to Work Charge, there is no question of the suspension order being issued against him, it said.
