A Division Bench of the Manipur High Court has granted an interim stay on a single bench judgment dated December 27 last year regarding the appointment of a Special Public Prosecutors in supernumerary posts.
The writ appeal was filed before the High Court against the judgment order by 10 Assistant Government Advocates cum Assistant Public Prosecutors who have been serving on contractual basis since 2009/2010 and were regularized in 2016.The respondents of the petition are the Law Commissioner, Government of Manipur, the Manipur Public Service Commission represented by its Secretary and Asem Neelakumar of Pishum Bazar who was appointed as a Special Public Prosecutors.
The petitioners claimed that their promotion to the post of Additional Public Prosecutors was overlooked, despite having served as Assistant Public Prosecutors for over seven years.
The petitioners alleged that the appointment of respondent Asem Neelakumar as Additional Public Prosecutor was arbitrary and violated Articles 14 and 16 of the Constitution.
During the hearing, Senior Advocate Prashant Bhushan, representing the petitioners, prayed for the admission of the writ appeal and sought to quash the single bench order.
He also requested the Court to direct the respondents to comply with recruitment rules and consider the petitioners' promotion to the next higher post.
The Division Bench, comprising Chief Justice Kempaiah Somashekar and Justice Ahanthem Bimol, after hearing the submission, stayed the judgment order dated December 27 last year and fixed August 22 for further hearing of the writ appeal.
