CBI files chargesheet in the Irom Rozer killing incident

Imphal, December 21 2011: After investigation into the firing incident that led to the killing of Irom Rozer on March 20 this year at Ghari along Imphal Airport road, the Anti-Corruption Branch (ACB), Imphal of Central Bureau of Investigation (CBI) has filed chargesheet to the court of Chief Judicial Magistrate of Imphal West for initiating necessary legal process against accused Nongthombam Ajay Meitei of Luwangshangbam Mamang Leikai to stand trial in the case.

The accused Ajay is the son of Minister N Biren.

The chargesheet of the CBI maintained that since sufficient evidences could not be collected against the four associates of the accused, namely Soram Raj Singh of Nagamapal Soram Leirak, Bachaspatimayum Roshinikumar Sharma alias Tolly of Brahmapur Thangapat Mapal, Thongbam Anilkumar alias Dhruba of Thangmeiband Maisnam Leikai and Puyam Shiddharatha Singh alias Boy of Singjamei Mayengbam Leikai Oinam Thingel Leirak, they may be discharged from the case.

The investigation into the case has been conducted by Additional SP of CBI, ACB, Imphal RK Agarwal of as IO and the chargesheet was filed to the court of CJM Imphal West on December 16 last.

According to information received by Hueiyen Lanpao, acting on a written complaint lodged by Irom Lokendro Singh, father of deceased Rozer, Singjamei police station initially registered the case as FIR no.131 (3) 2011 u/s 302/34 IPC & 27 Arms Act on March 20, 2011.After the case was transferred to CBI in pursuant of government of Manipur, Home Department notification dated April 1, 2011 concurred by the notification dated May 6, 2011 of government of India, CBI, ACB, Imphal registered the case CR2 (S)/2011-IMPH u/s 302/34 IPC & 27 Arms Act on May 7, 2011 for necessary investigation.

In his written complaint, Lokendro stated, accompanied by four other associates, his son Rozer was proceeding towards Imphal Airport along Tiddim Road in his i-20 car (MN-01W/7482) at about 2 pm on March 20, 2011, when some unknown miscreants numbering around 4/5, who came in a black colour Bolero Jeep (MN-03P/2417) from the same direction fired upon his son at Ghari village opposite KT Girls' Hostel without any reason.

As a result, his son sustained serious bullet injury on his neck and died on the way to hospital.

CBI investigation in the case revealed that at about 1 pm of March 20, 2011, the accused Ajay along with four other friends, Soram Raj, Anilkumar alias Dhruba, Siddharatha alias Boy and Roshnikumar alias Tony, were proceeding to drop Siddharatha at Khagempalli after enjoying a lunch at the residence of Soram Raj in the same black Bolero Jeep.

Soram Raj was driving the Bolero while the accused Ajay was sitting on the left side of the driver's seat, Roshnikumar in the rear seat behind the accused, Anilkumar in the middle seat and Siddharatha on the right side behind the driver.

When they reached Keishampat Junction, Soram Raj saw a white colour Maruti car moving towards Kwakeithel side along Tiddim Road in which a girl similar to one Sanatombi Devi, a girl friend of the Ajay was travelling with some other ladies.

At the direction of Ajay, Soram Raj followed the Maruti car.

But after it finding that the girl in the Maruti car not Sanatombi, the Bolero Jeep took a U-turn to go back to Khagempalli.

On the way, the occupants of the Bolero Jeep noticed two girls going toward Airport side on a Honda Activa.

Since it was the time of 'Holi' festival Ajay told Soram Raj to follow the girls with a view to tease them.

At about 1.30 pm of the same day, Rozer was also going along with five of his friends, namely Bidyachandra Sharma, Heiyairen, Rajbihari Singh, Ch Rajat Singh and Robert Singh in his white colour i-20 car (MN01W-7482) roaming the city to enjoy Holi festival.

Rozer also called another friend namely Kongkham Poireinganba of Bamon Kampu, who subsequently came in his Alto car (ML04A-1346) along with three other friends namely M Malemnganba Meitei, Kh Kishan Singh, and Motilal.

Since the i-20 car driven by Rozer was crowded, Rajat got down from i-20 car and got into the Alto car.

After this, both the cars, with the i-20 car in front, were heading towards the Airport side along Tiddim road, when they came across two girls riding on a Honda Activa near Kid's Foundation School, Ghari.

The occupants of i-20 car also decided to tease the girls and started moving parallel to the Honda Activa.

After sometime, the Black Bolero Jeep overtook the i-20 car and drove side by side of the two girls on Honda Activa and the occupants also started teasing the girls.

The investigation of the CBI further revealed that Rozer tried to overtake the black Bolero Jeep but he was prevented from doing so.

After several attempt, the i-20 car driven by Rozer succeeded in overtaking the Bolero Jeep.

But the Bolero Jeep again tried to overtake it and was almost driving parallel to the i-20 car when accused Ajay took out his licensed M-20 pistol and fired towards the i-20 car hitting Rozer on his neck.

Rozer ws immediately taken to RIMS hospital by other occupants of i-20 car but he succumbed to the bullet injury enroute and doctors declared him brought dead.

After the incident, accused Ajay fled along with his friends in his Bolero Jeep and straight-away reached his house at Luwangsangbam Mamang Leikai but the occupants of the Alto car followed the Bolero to note down the registration number.

Incidentally, Gurumayum Bidyachandra Sharma and N Rajbihari Singh, who were travelling in the i-20 car had seen accused Ajay firing at i-20 car with his pistol.

The investigation of CBI also revealed that there was no threat to accused Ajay or other occupants sitting with him in the Bolero Jeep and there was no reason for him to fire on the upper portion of the body of deceased Rozer who was driving the i-20 car.

Accused Ajay was issued the weapon for his self protection and at that point of time, there was no danger to his life or any other occupants of the Bolero jeep from any of the occupants of i-20 car.

Accused Ajay had full knowledge that the firing by him could take the life of any person sitting in the i-20 car.

If at all, he wanted to frighten them, he could have fired in the air or some outer part of the i-20 car.

Firing done by accused Ajay has taken away the life of an innocent boy without any cause or provocation.

In its chargesheet, CBI observed that 'it is well established that the accused N Ajay Meitei has murdered the deceased Rozer Singh s/o Shri I Lokendro Singh from his licenced M-20 pistol.

Keeping in view of the available evidence, the case stands proved u/s 302 IPC & 27 Arms Act, 1959' .

In its investigation, CBI has also taken note of the fact that after the incident, the black colour Bolero Jeep was produced at the police station but the widows of the Jeep were not tinted with black colour film.

Krishna Sharma, driver of the mother of accused Ajay had removed the black colour film before the vehicle was taken to the police.

As per the statement of Krishna Sharma, black colour film pasted on the widow glasses were removed by him and thrown into the garbage as told by N Biren, father of accused Ajay that pasting of black colour film on the glasses of car was against the law.
