'Extrajudicial killing': Court fixes October 29 for next hearing

Families of victims of June 18, 2001 incident, EEVFAM and wife of Pheiroijam Sanajit, who was killed in an alleged fake encounter on the intervening night of May 30 and May 31, 2004 filed Vakalatnamas before the Court of Chief Judicial Magistrate Imphal West yesterday in connection with the final/closure reports, CBI/SIT submitted in the two cases.
The Court fixed October 29 for further hearing of the cases.
The CBI/SIT which was constituted to investigate the cases as per the direction of the Supreme Court had submitted final/closure reports before the Court last month.
The CBI had submitted their final report under Section 173 CrPC in connection with the June 18, 2001 incident stating that no sufficient admissible evidence was found on record during the investigation to launch prosecution against the security personnel of CRPF.
It may be noted that 18 persons had died due to the alleged firing by security personnel on June 18, 2001 and since then the day is being observed as The Great June Uprising Day, Unity Day.
In early October, Chief Judicial Magistrate Imphal West had issued notice to families of victims of June 18, 2001 and EEVFAM (Extra Judicial Execution Victim Families Association Manipur) asking them to file objections, if any in connection with the closure report submitted by CBI SCB III New Delhi on the ground of no admissible evidence found against the CRPF personnel.
The Court had then fixed today for hearing.
During the hearing yesterday, family members of eight victims and secretary, EEVFAM filed their Vakalatnama through their Counsel in connection with the closure report of CBI and prayed for time.
The Court allowed the prayer and fixed October 29 for further hearing.
In the case of alleged extrajudicial killing of Pheiroijam Sanajit on the intervening night of May 30 and 31, 2004 at Khurkhul Phumlou, the CBI/SIT had submitted their final/closure report after the completion of investigation last month.
The closure report was submitted on the ground that the Central Government, particularly the Ministry of Defence has denied to accord prosecution sanction under Section 197 CrPC and Section 6 of AFSPA against four accused army personnel belonging to 19 Rajput (Bikaner)-Major Girish Nair (now retd) of Indore, then Captain Rahul Bal Mishra of Ahmedabad, then Havildar Ranbeer Singh of Haryana and then Sepoy Abhay Pratap Singh of Uttar Pradesh who are liable for prosecution under Section 302/ 342/201 and 34 IPC.
During the hearing yesterday, Rita, wife of Pheiroijam Sanajit and secretary, EEVFAM filed Vakalatnama through their Counsel and prayed for time.
The Court allowed their prayers and fixed October 29 for the next hearing.
