Remand for fratricide

The Court of Chief Judicial Magistrate Imphal East has remanded a 32-year-old man to judicial custody on charges of fratricide.
Accused Naorem Kulu @ Kulubidhu, s/o Thambou of Pukhao Ahallup Makha Leikai was arrested on September 20, 2025 from Kangla Sangomshang Lamkhai by a team of Sagolmang police station on charges of murdering his elder brother on September 19, 2025, around midnight at Pukhao Ahallup Makha Leikai, under the jurisdiction of Sagolmang police station, Imphal East.
Following the completion of his police custody, he was produced before the Court yesterday with a request for judicial custody remand.
The APP for the State submitted that Sagolmang police station received a telephonic report from Babina Hospital at approximately 12.46 am on September 20, 2025.The report stated that Naorem Amudon (49), the elder brother of the accused, was brought to the hospital around 11.52 pm on September 19 with multiple stab wounds and was declared dead on arrival.
Consequently, a suo moto case was registered for investigation.
What the APP submits
During interrogation, the accused stated that on the day of the incident, around 8 pm, his elder brother (the deceased) beat his sister-in-law with a wooden stick near their residence gate after she returned from a shop.
The sister-in-law fled the scene, and when the elder brother approached them, the accused reprimanded him, saying he shouldn't beat her like an animal.
The accused then went out with his wife to search for his sister-in-law in the locality.
The accused further revealed that later that night, his sister-in-law returned home, joined them for dinner, and afterward, everyone retired to their respective rooms for the night.
The accused stated that his elder brother, who was intoxicated, began murmuring, prompting the accused to ask him to stop.
An altercation ensued, and his sister-in-law left the house with her son.
The elder brother then challenged the accused to a fight, prompting the accused, along with his wife and son, to seek refuge at their parents' house.
After narrating the events to their parents, who advised them to stay calm and avoid conflict, the accused told his wife he would kill his brother and rushed back home.
Upon returning home, the accused retrieved a knife from his room and entered his elder brother's room, where he found him sleeping.
The accused stabbed his brother twice in the stomach.
A struggle ensued, during which the brother punched the accused in the face before eventually collapsing to the ground.
Afterward, the accused washed his hands in the courtyard, where his wife had just arrived.
The accused stated that he entered his brother's room after washing his hands and attempted to stop the bleeding by tying a cloth around the injured area.
He then shouted for help, asking a neighbour to bring his auto rickshaw to take his brother to the hospital.
However, his brother succumbed to his injuries at Babina Hospital.
The APP submitted that, given the facts and circumstances of the case, it is necessary for the accused to be taken into judicial custody in the interests of the investigation.
Therefore, the APP prayed for the judicial custody of the accused.
The Court after hearing the submission of the APP and on perusal of the case record remanded the accused to judicial custody till October 8 for smooth investigation of the case.
