Paraolon ambush of April 6, 2015 NIA Court rejects bail plea

Imphal, January 08 2017: The Court of Special Judge, National Investigation Agency (NIA) yesterday rejected the bail application of Kunlo Abi Anal who was arrested in connection with the Paraolon ambush of April 6, 2015 in which 18 soldiers of 6 Dogra Regiment were killed.

The bail application was filed by accused/petitioner Kunlo Abi Anal alias Ambison (37) s/o late Khumlo Kunjo Anal of Lalambung village, Chandel under Section 437 CrPC.

The accused was already in judicial custody when he was formally arrested by NIA on June 24, 2016 in connection with the Paraolon ambush.

He was first arrested by Imphal West commandos on June 16, 2016 from a rented house located at Lamphel Sanakeithel under an FIR case registered at Lamphel police station.

The counsel who appeared for the accused submitted before the Court that his client is innocent.

The counsel pointed out that the order which detained Kunlo Abi Anal under NSA in connection with the NIA case was earlier quashed by the High Court of Manipur.

Special PP(NIA), on the other hand, submitted that the arrest was made in connection with present NIA case in compliance with the Ministry of Home Affairs, Government of India.

Both the defence counsel and the NIA counsel admitted that a charge sheet has been already framed against the accused under Sections 302/307/120B/121 A IPC and 25(I) (C) Arms Act 5, Explosive Substance Act and 16/20 UAP Act.

The accused has so far not filed any appeal to review the charge sheet framed against him.

In the meantime, four prosecution witnesses have been examined so far.

After hearing both the parties, the Court ruled that it would not be proper and reasonable to release the accused on bail as it might hamper the trial.

Subsequently, the Court rejected the bail application.

Notably, Captain Karrapati Subhas, Resident Medical Officer of 6 Dogra Regiment gave his statement before the Court as first prosecution witness of NIA on October 10 last year regarding the charge sheet framed by NIA on April 16 last year.

The Court listed the case for next prosecution witness hearing on January 17 .
