Apex court trashes MLA Noorul's appeal

Imphal, May 08 2024:
A division bench of the Supreme Court of India headed by chief justice DY Chandrachud dismissed an appeal of incumbent Kshetrigao MLA Sheikh Noorul Hassan.
The hearing of the appeal filed at the apex court with MLA Noorul Hassan as appellant and Nahakpam Indrajit and others as respondents was conducted Wednesday at the division bench of the apex court comprising chief justice DY Chandrachud, justice Manoj Mishra and justice JB Pardiwala.
MLA Noorul Hassan's appeal challenged the leave granted by the High Court of Manipur on appellant's plea for replication of new facts as answers to the written statement submitted to the high court as per an order dated March 1, 2023 .
After patient hearing of statements from counsels of both the sides, the division bench ruled that non-disclosure of bank accounts of the candidate as alleged in the election petition has been clarified with written statement by the candidate himself.
The bench also said that the replication appeal is solely for clarification and does not contain any new material fact or new cause of action relating to election petition.
Accordingly, the high court's approval of filing replication was justified and the matter lies within the power of the high court, the division bench of the apex court ruled and dismissed the appeal citing lack of merit.
