Bail plea for assaulting cop rejected

Sessions Court Bishnupur today rejected two separate bail pleas filed by an accused in the assault case of Nambol OC.
Naorem Shanta (33) s/o N Shantikumar of Nambol Maibam Chingmang is mentioned as one of the accused in the FIR filed in connection with the assault of Nambol OC and his escort party.
In Shanta's first bail plea, his counsel mentioned that Shanta is currently serving as a Havildar in 25 Assam Rifles, Jwalamukhi, Lairouching, Senapati district and his client has been falsely implicated in the case.
Shanta's counsel, in his statement submitted to the Court, said that on September 30, a team of Nambol police led by its OC came to Shanta's house and enquired about contraband ganja.
Although, the police team could not find any contraband item in Shanta's house, they started beating up Shanta's mother.
Suddenly, a mob gathered at their locality and attacked the police team after somebody shouted that police had beaten up a woman.
In the melee, Nambol OC and a police personnel were seriously injured.
On the other hand, police FIR said that on September 30 at around 6.10 pm, an unruly mob consisting of men and women numbering around 300 suddenly assaulted Nambol OC and his escort party while the police team were verifying some drug users, who often create nuisance and disturbances to the public by consuming drugs and ganja at the residence of Naorem Shantikumar.
The mob allegedly used deadly weapons while attacking and attempting to take the life of Nambol OC and his escort party, the FIR added.
It further said that the mob also allegedly obstructed the police team who tried to evacuate the injured police personnel including Nambol OC and also attempted to assault other police personnel who rushed to the spot as re-enforcement team and also burned down the vehicle allotted to Nambol OC.
Attacking security personnel while performing their duty and stopping the process to evacuate the injured persons to hospital are serious offences, the FIR said and added that Nambol OC is still lying unconscious in the hospital.
After perusing the FIR, the Court observed that there is no ground to grant a pre-arrest bail to Shanta as his name is clearly mentioned in the FIR.
On the other hand, the Court also rejected Shanta's bail plea in the case of leading a mob to attack the house of one Warepam Amumacha Devi the same day.
Shanta's counsel in his bail plea said that Shanta was not in his house when the incident happened as he went to the hospital for the treatment of his injured mother.
However, the FIR, filed by Warepam Amumacha Devi said that around 50 people led by Shanta and four others came to her house and allegedly threatened her family members by using machetes, sticks, stones etc.
They also allegedly pelted stones at Amumacha's house accusing her son of being an informer of the police and security force.
As a result gate, fencing, doors, windows and walls of her house were badly damaged and her husband Samungou was rushed to the hospital after he fainted.
As Shanta's name was mentioned as accused number one in the FIR, the Court observed that there is no ground to grant bail to him.
