In a major boost for former Joint Secretary of the Board of Secondary Education, Manipur, Kh Nandakumar Sharma, the Civil Judge, Junior Division has stayed the suspension order issued against him by the Secretary of the BSEM on September 7.After perusing the matter, the Civil Judge ruled, � I have formulated my view on the basis of the documents, Affidavit and provisions of the Act that the OP has no power to issue the order dated 7/9/2006 as it appears contrary to the provisions of the Act.� Observing that if the Court does not interfere at this stage, the petitioner, Kh Nandakumar will suffer irreparable loss, the Court ruled that the suspension order be stayed until further orders.
While issuing the stay order, the Court also issued a notice on the respondent making it returnable by September 26 for hearing.
The petitioner is also free to take legal help, said the order.
A copy of the said order was also issued to the OC of Imphal police station for information and necessary action.
Kh Nandakumar was suspended on charges of wrongly appointing a number of employees in his capacity as the Joint Secretary of the BSEM.
