Imphal, July 22 2009: Exposing the shortage infrastructures and lack of power for effective functioning of the Manipur Human Rights Commission, a member of the Manipur Human Rights Commission today said that if the commission is to be kept in the present condition, it is better to abolish it.

Addressing at a press conference, RK Rajendro, member of the human rights commission at its office at Lamphelpat said that the commission is functioning without devolution of actual power to be given by the government by not paying incentives which is the main hindrance in the functioning.

Apart the commission had no proper infrastructures require of the administrative division, law division, training division, policy, research, project and programme implementation division and public relation division.

The seat of the chairperson is also still lying unoccupied by none since the retirement of the former chairperson a year back.

According to the section 21 (2) of the state human rights commission, a person who was chief justice in a high court should be the chairperson of the commission, Rajendro said.

The secretary of the commission should also be by a person serving at the rank of secretary in the state government administration.

But, still date, a deputy secretary of the state law department is looking after the charge of the secretary of the commission.

The commission is yet to have its own police investigation team even though an officer not less than the rank of IG is to be deputed as rights' investigation team with its necessary manpower under section 27 (B) of the commission.

In states likes Punjab, West Bengal and Jammu and Kashmir, the rights commission has police investigation team led by an additional DGP with adequate staffs.

If the team be deputed, the alleged fake encounter could be checked up 90 percent, Rajendro observed.

In reply to a question why police are not willing to help rights commission, if police personnel are sincere enough in discharging duty and have the spirit of patriotism, fake encounters could be check.

There is none to believe when security forces alleged of initiating the firing from underground sites and killing the undergrounds without causing any injuries to the security men as real clash between the undergrounds and security men.

There have been allegations to the security forces detaining a man picked up by them for some days and killed later instead of handling over to the police.

Apart from all this, if an man be killed in encounter, the post mortem report, inquest reports, chemical analysis report etc.

is to be submitted by the police station concerns within the next 24 hour.

If not submitted, it can be assumed that police has concealed some truth behind the incident.

This does not happen in Manipur, the rights member observed.

In the presidential order, member of a right commission is at 17th while chief secretary of a state at 23rd.But in Manipur in the state function like the celebration of the Republic Day, chief secretary is in the front which is a shameful attitude, he added.
