Court frames charges against Mark Haokip

Special Judge, NIA Imphal West today framed charges against Mark Thangmang Haokip under section 13 UA (P) Act and section 648 IPC and fixed February 9 for recording his plea.
Mark Thangmang Haokip (40) s/o Limkhosei Haokip of Molnom village, Churachandpur, president of an outfit named Government of People's Democratic Republic of Kukiland was produced before the Special Court, NIA Imphal West for charge hearing through video conferencing.
The Court heard the submissions of the Special PP and the defence counsel.
The Special PP submitted that the complainant who is a Sub-Inspector at Imphal PS submitted a written report stating that Mark Thangmang Haokip, who is the president of an outfit called Government of People's Democratic Republic of Kukiland, was involved in a conspiracy to secede from India and to wage war against the Government of India and he attempted to wage war.
The complainant conducted an enquiry and found that the accused was actively present in social media.
His posts from time to time revealed that he abetted and instigated common people to fight against the Government.
It was also alleged that his acts were tantamount to hatching conspiracy or making attempts to commit terrorist acts or acts preparatory to the commission of a terrorist act.
The accused had been raising funds from different individuals and some individuals were helping him in raising funds.
These funds were suspected to be used towards funding various terrorist activities.
The group has been working towards destabilising the country and is a threat to the security of the State, the Special PP said citing the complainant.
Subsequently, an FIR was registered and Mark Thangmang Haokip was arrested on May 30, 2022 from Kishangarh, New Delhi.
During investigation, the accused divulged that he was the president of an outfit called Government of the People's Democratic Republic of Kukiland and disclosed the names of following fellow office bearers; KS Kipgen- Secretary (Admin) Lunkhohao Haokip- Secretary Political Affairs and CSK Mate- Press Secretary.
The accused was actively involved in spreading propaganda through social media with an ulterior motive to create instability, communal hatred, animosity and incite violence to achieve the organisational goal i.e, the Democratic Republic of Kukiland.
Because of Mark Thangmang Haokip's continuous rants through social media posts on sensitive issues, many law and order situations occurred The accused through his propaganda and instigation, mobilised people and obstructed people when they went for a tree plantation programme at Thangjing Hills.
Because of his act, the matter was about to escalate into communal hatred and tension between Meitei and Kuki communities in the State, the Special PP submitted.
In April, 2021, in defiance of a Manipur Government order, the accused instigated people and obstructed officers and officials of Forest Department, Art and Culture Department and DFO Kangpokpi when a Government team went to Kanglatongbi-Kangpokpi reserved forest area for surveying/declaring the sacred site of Lord Koubru and Lai-Pukhri at Koubru range.
Again on May 21, 2022, the Churachandpur police sent summons to the accused requiring his appearance before the IO for investigation of a case registered against him but a violent mob stormed the streets and the police station.
On May 25, 2022, members belonging to the accused's group launched a violent protest against the Government of Manipur in the Kuki dominated area in Churachandpur and Kangpokpi districts against his arrest by a team of Manipur Police at Delhi.
Some police personnel and civilians got injured in the violent protest.
In further investigation, screenshots of Facebook posts made by the accused were taken.
Many incriminating documents and articles were also recovered from his possession.
One diary belonging to the accused which disclosed the plan of KSRO (the former name of People's Democratic Republic of Kukiland) to gain sovereign power against the State for the so-called Kukiland which comprises areas falling under India, Burma and Bangladesh was also seized.
The group also owns a website by the domain name www.kukigovt.com to propagate their ideas and hatch conspiracy against the Government.
Many incriminating materials were found from the website.
A press release dated 23-10-2019 signed by the accused and three other members was also found in the letterhead of the Government of People's Democratic Republic of Kukiland.
It was also submitted that February 4, 2020, the accused posted some message through his Facebook account i.e."Mark t Haokip" in which the accused declared- "DRK (Democratic Republic of Kukiland) will not accept and compromise anything that threatens the sovereign rights and dignity of Kuki Nation.
It is our highest solemn petition to the world to recognise the Democratic Republic of Kukiland and our determined aspirations to make it a pure Christian country" .
Several pictures of militants with arms and ammunition were detected from the accused's mobile phone.
The accused had used a fake SIM card and also found that he had forged his own character/verification certificate purported to have been issued by the Churachandpur police station for the purpose of applying for an Indian passport.
The Court, after hearing the submission of the Special PP and the defence counsel, ordered to formally discharge co-accused B Demmounmang Vaiphei alias Mang and charges shall be framed against Mark T Haokip for offences under Section 13 UAPA and Section 468 IPC .
