Two rape accused granted bail

The Special Judge, POCSO Imphal West has released two rape accused as the prose-cution had failed to submit the charge sheet/final report.
The two accused have also completion their statutory period of 180 days.
The order was passed today in connection with a bail application filed by accused Heigrujam Diya alias Dayananda (38), s/o (L) H Ibomcha of Uchiwa Leirak Achouba and Shagolsem Sanahal Singh (38), s/o Sh Mani Singh of Uchiwa Lei-rak Achouba.
The Court heard Special PP who submitted that on December 6 last year, the mother of the victim lodged a complaint to the Officer in-Charge of Imphal West women police station.
As per the complaint, her daughter was sexually assaulted by the two accused on September 1, 2021 inside one departmental store located at Mayang Imphal Bazar and threatened her (the alleged rape victim) to not disclose the incident to anyone.
The complainant also said that she could not report the matter on time due to lack of legal knowledge.
The Special PP also submitted that the two accused had committed a heinous offence and they might abscond and temper the evidence.
On the other hand, the defence counsel submitted that the accused were arrested on December 10, 2021 and since then they have been languishing in custody.
It also submitted that the accused had spent more than 180 days in custody while the prosecution had failed to submit the charge sheet/final report.
The defence counsel also submitted that the two accused will comply with all the conditions imposed by the Court and are ready to furnish the necessary bond.
The Court, after hearing both parties and on perusal of the case record, granted bail to the two accused on furnishing a PR bond amounting to Rs 1 lakh with a surety of the same amount.
The Court also directed the accused to cooperate with the investigation and make themselves available before the Court or the investigating authority as and when directed to do so.
The two accused have also been directed to not influence prosecution witnesses and refrain from leaving the State without prior permission of the Court.
