Sessions Judge Imphal West grants interim pre arrest bail to six petitioners

Session Judge Imphal West granted interim pre arrest bail to six individuals in connection with an FIR registered by Lamsang Police Station regarding September 8 night incident which took place at Lamdeng Awang Leikai relating to the public gathering/ meeting organized by Education Minister and his workers.
Six different anticipatory bail applications was filed by Thounaojam Dhaneshwor (50 yrs) of Lamdeng Awang Leikai, Chingangbam Chaoba (70 yrs) of Lamdeng Mayei Leikai, Chingambam Abraham (68 yrs) of Lamdeng Mayai Leikai, Chingangbam Ibochou (58 yrs) Kuber of Lamdeng Mayai Leikai, Chingangbam Opendro (55 yrs) Chaoton of Lamdeng Mayai Leikai and Ngasepam Ito (60 yrs) of Lamdeng Mayai Leikai under section 438 Cr PC praying for granting pre arrest bail with the FIR case coupled with an interim relief.
Court registered it as Cril AB case and heard the counsels of petitioners who submitted that on September 8, 2021 at around 7.30 pm regarding the incident which took place at Lamdeng Awang Leikai relating to public gathering/meeting organized by the Education Minister and his worker and prior to the meeting the club members and Meira Paibis of the locality have requested not to organize such public gathering/meeting in view of the grim situation of COVID-19 pandemic.
However some people from the locality attempted to organize the meeting in connection with the upcoming State Assembly election and as such misunderstandings cropped up amongst the residents of the localities and consequently police force were engaged to disperse the crowd.
On the next day (September 9) some personnel of Lamshang Police Station enquired the whereabouts of the applicants in connection with the incident and also stated that the applicants are not involved in the said incident.
But due to the anticipation that they might be arrested by the police personnel of Lamsang Police on false and concocted charges and thus prayed for the interim pre arrest bail.
The Court will consider the matter after the detailed report is received from OC Lamsang Police Station on September 22.Accordingly OC is directed to furnish a detailed report regarding the FIR and in the meantime, interim pre arrest bail have been granted to the petitioners.
In the event of arrest of the petitioners in connection with the case, the petitioners shall be released on interim bail by furnishing a PR bond of Rs 20,000 (Rupees twenty thousand) and surety of same amount, petitioners should be available before the investigating agency and the petitioners shall not influence prosecution witnesses and petitioners shall not leave Manipur without prior permission from the Court and fixed September 29 for report and hearing.
