Imphal, July 16 2019:
Chief Judicial Magistrate Imphal West rejected the bail application filed by Naorem Dijamani today and instead directed the SP of Manipur Central Jail Sajiwa to make necessary arrangements for Dijamani's treatment and to provide the necessary medication regularly.
The order was passed after hearing the bail application filed by Dijamani praying for granting him bail on health ground.
The counsel of Naorem Dijamani (67) s/o (L) Basudeva Singh of Singjamei Thokchom Leikai, submitted that Dijamani is an old but respectable member of the society having no criminal record and is completely innocent of the allegations levelled against him.
The counsel continued that on the fateful date on which his wife, Naorem Rekha was found murdered, Dijamani was in his office and after he was informed about the incident, he came home to find his wife already dead, lying in a pool of blood.
Shocked, he took out a cloth and placed it below his wife's head in front of many individuals who were present at the site, which caused blood to splatter on to his pant, the counsel stated.
The counsel also submitted that a sum of about Rs 4 lakh was stolen from the purse of the deceased which was kept inside the almirah (which was pried open following the incident) and some ornaments were also missing from the body of the deceased as well.
All materials clearly show that Dijamani was not involved in the offence but is a victim, the counsel contended, adding that it is quite known to the locality that deceased was always at home alone during day time and Dijamani used to come back home at around 4.30 pm.
As such, anyone can commit the offence easily, the counsel reasoned.
The investigation of the case is only confined to Dijamani as a suspect, instead of trying to find out the truth and Dijamani has already been in police custody and judicial custody for 49 days now which makes further remand no longer required as investigation in his respect is completed, the counsel submitted adding that Dijamani will cooperate if he is released on bail and prayed for releasing him on bail.
On the other hand, the APP of the State submitted that sufficient circumstantial evidences exist against the prime suspect Dijamani and as such, he cannot be released on bail at the present stage when the investigation is going on steadily.
After hearing both sides and going through the prosecution materials, seized items, reports of forensic science laboratory and mobile forensic tracers, the Court ruled that Dijamani's ailment should be managed from the jail with proper medication, exercise and diet by jail authority concerned and directed the authority to take him to JNIMS and RIMS for further treatment and medication if any complication arises.
