Rape accused, co-accused file anticipatory bail plea

The Session Judge, Imphal West on Monday called report from the Officer-in-Charge of Imphal West Women Police Station on the anticipatory bail applications filed by rape accused Yumnam Surjit-kumar Mangang, managing director cum founder of Saina Institute of Medical Science (SIMS) and assistant director of the institute Md Wajid.
The Court would give its judgement on August 24 .
The anticipatory bail applications were filed by the respective counsels of Surjitkumar (42) s/o Saratchandra Magang of Khurai Kongkham Leikai and Md Wajid (34) s/o Kiramuddin of Hangul Makha Leikai.
Surjitkumar's counsel submitted that the petitioner has learnt of the written complaint filed at Imphal West Women police Station which accused him of raping a student of the institute.
The counsel contended that the petitioner started having an affair with the complainant from August 14, 2020 and their relations are known by the families of the two sides too.
It was also submitted that petitioner and the complainant had gone to Goa and many tourist locations in Manipur together.
Saying that they went to Andro with some of the petitioner's friends and colleagues on August 14, 2022 to celebrate their 2nd anniversary, the counsel continued that two teachers of SIMS-Laishram Kunja-rani and Sonia Yambem picked up the complainant from her residence and they came to Andro together.
Further stating that they had meal at around 1.30 pm and left the place in two cars, the counsel claimed that the petitioner and the complainant were in different cars on the return journey.
The car occupied by the complainant was stopped midway as she complained of nausea due to travelling for long hours, the counsel claimed and alleged that the complainant, after resting for a while, hesitated to return home as it was getting late.
The petitioner agreed to elope with the complainant as proposed by the latter, it claimed.
The counsel further submitted that the complainant was taken to the house of the petitioner the following day while the elders of the petitioner went to convey the message (of elopement )to the family members of the complainant.
Rs 50,000 was given to the complainant as a tradition, it claimed and alleged the complainant, on reaching her home, was beaten by her elder sister in front of all.
It was submitted that the petitioner genuinely loves the complainant.
The counsel claimed that the 'false' complaint might have been filed due to some external influence.
The Court, on perusal of the anticipatory bail applications filed by the two accused and after hearing the submission of the counsel, observed that the matter will be considered after the detailed report is received from the Officer-in-Charge of Imphal West Women police station.
Notably, the same Court had granted interim pre-arrest bail (anticipatory bail) to two co-accused of the case namely; Yambem Nonibala and Laishram Kunjarani Devi on August 20 .
