In connection with the killing of two UG suspects, who were cousins, in a reported encounter with police commandos, the Gauhati High Court has served notice of motion on the State Government.
The cousins, Mutum Herojit (28) s/o late Kumar and Mutum Rajen (22) s/o late Ibomcha of Keishampat Mutum Leikai were shot dead by Imphal East commandos in a reported encounter on Lambui road, to the East of Imphal East DC office on October 14 last year.
The notice of motion was issued following petitions filed at the Court by M Roni, wife of Herojit and M Ibecha, wife of Rajen.
The petitions were filed demanding commensurate compensation for killing innocent people from the State Government, the DGP and the Imphal East SP.
It also sought prosecution of the commando personnel involved in the killing.
Advocate Khaidem Mani, assisted by Advocates Meihoubam Rakesh, Yumnam Devdutta and other of the Legal Protection Centre, appeared on behalf of the petitioners.
The notice of motion returnable within four weeks was issued by a Division Bench of the Gauhati High Court comprising of Justice MBK Singh and Justice AK Upadhyay.
Khaidem Mani said that Mutum Herojit went to Chingmeirong on a Kinetic Honda at about 2 pm of October 14 last year to edit video footages of a family ceremony (mana hutpa function of his son) along with his cousin Rajen.
The cousins were in the studio at Chingmeirong till 5 pm of the day.
They were picked up by police commandos from near LMS Law College, Chingmeirong and shot them to death at Lambui road in an alleged fake encounter, said Khaidem appearing for the case.
One SI P Achouba Meitei furnished a false report to the OC of Porompat police station stating that the two were killed in an encounter.
Informing that father of Mutum Herojit, Kumar, filed complaints to concerned police station and the State DGP to register an FIR and to deliver justice, Mani disclosed that Kumar again submitted a report to the OC of Porompat PS on Jan 3 this year but the OC refused to accept the report.
Subsequently, the report was submitted to the Imphal East SP.
Observing that such alleged incidents of killing people after being pulled violate the right to life guaranteed under Article 21 of the Constitution of India, Khaidem appealed to the Court to judge the complaints.
