Senapati District Bar Association has outrightly condemned the statement made in an interview by one Meerajao Kamei, who is the JAC convener formed with regard to a rape case, which was widely circulated on social media through WhatsApp and the same uploaded on the Facebook page of a web news portal.
In a release, the association of Senapati legal practitioners ridiculed views of the JAC convener as well as condemned the unethical comment made by the executive editor of the web news portal against the special public prosecutor regarding the Lhukhosei Zou case in the interview.
The judgment and order of the said case was pronounced by the judge and not by the special public prosecutor, pointed out the Bar Association and expressed strong resentment that such unfounded claims has defamed the judicial system at large.
It also pointed out that there is always an appellate court to approach if the JAC convener is aggrieved and the special public prosecutor has nothing to do with it.
It is very unfortunate on the part of the convener to make such remark when the case is at the stage of charge hearing.
The interview which has been widely circulated on social media is an attempt to form a public opinion'against the special public prosecutor with intent to tarnish her image.
The case is not even taken cognisance of by the Special Court (POCSO), Senapati.
Therefore, the very intention of the JAC convener is to create prejudice and tarnish the image of the special public prosecutor and the criminal justice system, it alleged.
The Bar Association further observed that the JAC convener is presumed to know that under the law, an accused has the right to a fair trial and is innocent until proven guilty in a court of law.
Such attitude of the convener in taking help of social media and trying to tarnish the image of the criminal justice system is condemned in the highest form, it said.
