Bail plea rejected

The Session Judge Imphal West has rejected the bail application filed by Leiphrakpam Premananda who runs a non-profitable/charitable rehabilitation centre "Revive Drug De-Addiction Cum Rehabilitation Centre" at Utlou Chanura Bazar in connection with the death of one Lukram Sanjoy Singh Ningthou on June 2 last.
The bail application filed by the wife of Leiphrakpam Premananda Singh (39), s/o L Palandro Singh of Kwakeithel Ningthemkol was kept on reserve after the hearing on July 7 .
The case was on against the accused after the death of L Sanjoy on June 2 at SAIYON Hospital, Nambol Makha.
Reportedly, the deceased, who was an inmate of Revive Drug De-Addiction Cum Rehabilitation Centre, Utlou Chanura Bazar was brought dead with bruise marks on his thigh and buttock.
The defence counsel submitted that the accused and co-accused Takhelmayum Tingku Singh runs the non-profitable/charitable rehabilitation centre.
It claimed that Lukram Sanjoy was admitted to the centre on May 31 and he was kept at the detoxification room.
Claiming that Sanjoy tried to escape from the centre on June 2 at around 1.30 pm, the defence counsel continued that the deceased was whipped with a bamboo branch by the accused for using abusive language during the counselling.
Continuing that the deceased was evacuated to the hospital at Nambol as he was found unconscious at around 7.30 pm, the defence counsel stated that the doctors, however, confirmed that the inmate was brought dead.
The defence counsel also claimed that the accused didn't have any intention to kill and was not aware of the assault committed by co accused Wairokpam Jagatchandra Singh.
On the other hand, the PP submitted that the accused brought the 'victim' from Nambol police station and lodged him at the 'unauthorized rehab centre' at Utlou Chanura Bazar.
The PP claimed that the victim was beaten severely by Takhelmayum Tingku Singh and Potshangbam Umamanda Singh for planning to escape while Naorem Sanjit Singh, Thiyam Yaiphaba Meitei, Javed Puyam and Sanjenbam Jogeshkumar Singh held his hands and legs on June last.
Further claiming that 'victim' was again beaten by Yaiphaba, Sanjit, Javed, Kangabam Chingkhei Singh and Jogeshkumar, it claimed that Premananda took a bamboo from Yaiphaba and beat the victim 5 to 6 times at his buttock at between 2.30 pm and 3 pm.
Later that evening at around 7.30, the accused along with Tingku after buying pork for dinner returned to the rehab and saw Jagatchandra beating the victim while Yaiphaba and Sanjit held the hands and legs of the victim.
After some time the victim collapsed and he was rushed to the SAIYON Hospital by the accused with Tingku, Jagatchandra and Yaiphaba but the doctor declared that 'victim' was brought dead.
