Imphal, November 22 2021:
Written complaints for disqualification have been lodged to the speaker's tribunal of the Manipur Legislative Assembly against Sagolband MLA RK Imo and Saikul MLA Yamthong Haokip, both of whom, though elected on INC ticket in the 11th Manipur Legislative Assembly election, joined BJP recently.
Manipur Pradesh Congress Committee (MPCC) general secretary cum election and media in-charge Soibam Jiten was the petitioner in both the written complaints submitted to the speaker's tribunal against the former INC MLAs.
After submitting the written complaints, Soibam Jiten told media persons that Saikul MLA Yamthong Haokip and unattached Sagolband MLA RK Imo violated the 10th Schedule of Indian Constitution by joining BJP on November 8 and accordingly filed the disqualification complaints against them in the speaker's tribunal.
It is clearly mentioned in Article 191 of the Indian Constitution about disqualification of members while Sub-clause 1 of Para II of the 10th Schedule of the Constitution also clearly explained about disqualification of MLA if he or she happens to leave the party.
Accordingly, the petition seeks disqualification of the two MLAs based on the relevant schedules, he said, adding that the petitions were received by secretary to speaker as the latter was physically not present at the time of submission.
He also said that the petitions were submitted to the speaker's tribunal so that copies of the same could reach the respondents.
If the speaker honours Indian Constitution and follows constitutional norms, both the MLAs could be disqualified within a short time, Jiten replied, while responding to a query raised in this regard by media persons.
Meanwhile, Jiten also informed media persons that the Supreme Court had on November 9 intimated the Governor to give final decision on disqualification of 12 MLAs who were appointed as parliamentary secretaries and there is high hope that the Governor would give a final decision on the matter at the earliest.
