A Division Bench of the High Court of Manipur comprising of Chief Justice Ramalingam Sudhakar and Justice Kh Nobin today passed an order whereby an order issued by the Revenue Department on July 17 this year has been stayed.
The order issued by the Revenue Department on July 17 imposed an arbitrary condition requiring approval of a screening committee constituted under the same order prior to registration of deed for transfer of immovable properties.
Challenging the department's order, one Wahengbam Chandrakumar filed a PIL before the High Court through advocate Meihoubam Rakesh, according to a press release issued by the Human Rights Law Network.
As per the department's order, any registration is to be done only after obtaining due recommendations from the screening committee.
The impugned order further directed that any registration officials of the State shall not register any transfer of landed property without obtaining the approval of the screening committee.
After the issuance of the impugned order, all the registration works have been brought to a standstill as the registering authorities have refused to register any document relating to transfer of land property unless an approval is obtained from the screening committee.
The Division Bench took up the PIL today during which the Advocate General furnished a letter giving justification for issuance of the impugned order.
After hearing both the parties, the Division Bench passed a stay order apart from listing the PIL for next round of hearing on September 18, added the HRLN press release.
