Imphal, August 26 2021:
The Supreme Court has fixed September 2 for the final disposal of the writ petition filed in connection with the appointment of 12 MLAs of the ruling BJP government in Manipur as parliamentary secretaries, citing it to be under the purview of Office of Profit and seeking the disqualification of the 12 MLAs concerned.
Owing to the similar nature of the Writ Petition (civil) Case no 152-2021 filed by Congress MLA DD Thaisii against the Election Commission of India (ECI) along with the Special Leave Petition (Civil) Case no 2001-2005-2021 filed by Manipur Government and the SLP (Civil) Case no 2386-2390-2021 filed by Khurai AC MLA Leisangthem Susindro, the petitions were listed in the 8th serial number, scheduled for hearing on Thursday.
However, the bench of Justice L Nageswara Rao and Justice Aniruddha Bose saw to the hearing of the previously listed cases and as such, the case of the 12 parliamentary secretaries could not be heard due to paucity of time.
Thus, owing to this delay, the final disposal of the case, which was initially scheduled for Thursday, has been fixed on September 2 .
A cause list has been notified in this regard.
Mention may be made here that the 12 MLAs, namely L Susindro (Khurai AC), N Indrajit (Kshetrigao), L Rameshwor (Keirao), Th Satyabrata (Yaiskul), H Dingo (Sekmai), Dr S Ranjan (Konthoujam), S Subashchandra (Naoriya Pakhanglakpa) who has since resigned from the Assembly, K Robindro (Mayang Imphal), Leishiyo Keishing (Phungyar), Khasim Vashum (Chingai), Awangbow Newmai (Tamei) and Asab Uddin (Jiribam) were appointed as Parliamentary Secretaries.
The High Court of Manipur had earlier passed a judgment declaring the appointment unconstitutional and invalid under the Manipur Parliamentary Secretary (Appointment, Salary and Allowances & Miscellaneous Provision) Act 2012 and the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Repealing Act 2018 .
