Court to hear CBI's response on Dec 10

The Chief Judicial Magistrate, Imphal West, has fixed December 10 for hearing CBI's response in connection with the involve-ment of army personnel in the alleged fake encounter/extra judicial killing of one Thang-jam Thoithoi alias Anil Kumar of Thangmeiband Sinam Leikai in the evening of January 14, 2012 at Mayai Lambi junction (towards Narankonjin Chandranadi road) by a combined team of Imphal West and Imphal East commando and 18 Sikh Regiment.
Mention may be made that in the charge sheet submitted by CBI/ SIT in connection with the case, the names of a few personnel of the 18 Sikh regiment were mentioned but they were not charge sheeted on the ground that no prosecution sanction against Indian Army personnel was accorded under AFSPA by the Centre.
Today, all the accused police personnel of Imphal West and Imphal East commando who were charge sheeted by CBI in connection the case, appeared before the Court with their respective counsels as per an earlier summon (issued by the same Court) on October 16 .
During the proceeding, the CBI prayed for some time regarding the Army personnel involved in the case and as such, the Court fixed December 10 for the hearing.
The charge sheet of CBI/ SIT submitted on October 16 named nine State police personnel as charge sheeted individuals, along with the names of now Lieutenant Colonel (then Major) of 16 Sikh regiment Kamal Sajgota of Arnia Jammu, Havildar Baljit of Raju Bela village (Punjab) and Havildar Sarvjit of Kurukshetra (Harayana) as non-charge sheeted Indian Army personnel in connection with the extra judicial killing case.
The charge sheet also mentioned that during the investigation, it was revealed that a total of 25 bullets were fired by Imphal West commando while another 21 bullets were fired by Imphal East commando during the alleged fake encounter.
Kamal Sajgota, Sarvjit, Baljit and Lance Naik Ranvir of 18 Sikh regiment stated during investigation that they also fired some bullets during the encounter but claimed that they do not remember the exact number.
The combined team had fired a total of 119 bullets in the alleged fake encounter (by a total of 16 personnel) even though they could have overpowered and immobilized the victim without resorting to use of firearms.
The charge sheet had also mentioned that the Government of India, Ministry of Defense, denied to accord sanction for prosecution under section 6 of the Armed Forces Special Powers Act against Kamal Sajgota, Havildar Sarvjit and Havildar Baljit .
3 days after the submission of the charge sheet before CJM, Imphal West, 9 police personnel of Imphal West and Imphal East, namely Jamandar Laitonjam Bibekananda, Sub Inspector Laikhuram Lenin, Head Constable Ronra Mataisang Shimray, Head Constable Moirangthem Kiran, Jamandar Arambam Sunder, Rifleman Nongthonbam Brajamani , Head Constable Aribam Captain Sharma, Head Constable Thokchom Amarjit and Constable Huidrom Indrakumar appeared before the Court on October 19 and filed applications for leave to surrender and to release them on bail.
They were later released on bail the same day.
