2 held for uploading obscene video further remanded to custody

Two persons who were arrested for uploading and circulating an intimate video clip of an individual and his friend have been remanded to judicial custody will October 10 .
The CJM, Imphal West ordered the remand today and they were arrested by the Cyber Crime Police Station.
The accused youths identified as Kshetrimayum Kelvin (19) of Kakching Irum Mapal and Kshetrimayum Roshan (18) of Kakching Ningthou Leikai were produced before the Court of the CJM Imphal West after completing 4 days police remand along with a prayer for remanding them to judicial custody for further investigation of the case.
On the other hand, the defence counsels of the accused filed remand objection along with a prayer for releasing them on bail.
IO of the case through the APP submitted that on September 26 a compliant was lodged by the victim to the Cyber Crime Police Station Manipur stating that one video clip having intimate contents with his girlfriend was circulated through Whatsapp and it had gone viral.
A regular case was then registered for investigation.
During the course of investigation the person who uploaded/shared the video clip was identified as one Kshetrimayum Kelvin and further, it was revealed that the video was shared to him by one Kshetrimayum Roshan.
Accordingly, the two individuals were arrested by Cyber Crime police and the mobile phone used in the commission of the crime were seized.
During interrogation Roshan revealed that one of his friends, Dorendro had shared the video and the same was forwarded to co-accused Kelvin.
However incriminating data of the video clip were not found in the seized mobile phone and on being asked both of them stated that source of the video is not known to them.
IO further submitted that accused after uploading the same had deleted the evidences so as to avoid being pulled up.
The seized mobile phone handset has been sent to Mobile Forensic to retrieve the deleted evidences.
IO also submitted that if the accused persons are released on bail, the other accused persons who are yet to be identified will be alarmed and whole progress of the investigation may be derailed.
After going through the case record and hearing the submission of the APP and defence counsels, Court rejected the bail plea and remanded them to further judicial custody till October 10 .
