Court directs govt to appoint a surrendered UG in govt job

The Gauhati High Court, Imphal bench has directed Manipur government to appoint a surrendered militant as follower in the police department within a month period.
The court passed the order after a hearing to a writ petition filed by Moirangthem Sana Singh of Phumlou Siphai of Imphal west district, a hardcore member of a banned organisation, who appeared special DPC for appointment to the post of rifleman and followers held from September 6 to October 10, 2002 .
The special DPC had recommended 74 surrenderees for appointment in the two categories.
40 of them were recommended for appointment as riflemen and 34 surrenderees were recommended for appointment as followers in 4th IRB and he was among the recommended candidates for the post of followers.
However, the petitioner was not allowed to joint the service even though some of them who appeared in DPC were allowed to joint, based on the report of police verification and medical fitness examination.
When he petitioned the DGP for reconsideration to his appointment but rejected saying there was no vacancy as on July 1, 2006.At the same time, the monthly stipend of Rs 2000 enjoyed by him under surrendered policy of the state government was suspended.
The state of Manipur is heavily infested by many underground organisations and many youths who are misguided join underground organisations.
As a result of the many unlawful activities of the members of the undergrounds, the state of Manipur has a serious law and order problem.
In order to solve the problem of underground activities, the state government, as approved by the government of India, formulated a scheme for surrender-cum-rehabilitation of militants in the northeast states and the said scheme had been circulated to all concerned.
The policy stated that the benefits under the scheme are applicable to those militants who had surrendered after April 1, 1998.The petitioner is also a surrendered and he surrendered before the Imphal West SP.
He has the right to enjoy the facilities given to the surrenderees.
He should be given the appointment as he had passed all the process for appointment, the judge pronounced.
