HC directs CBI to probe Rohit's death case

Imphal, July 30 2022:
The High Court of Manipur on Friday directed the Central Bureau of Investigation (CBI) to investigate the death of Ningthoujam Rohit (27) of Heirok Part-II Mayai Leikai, Thoubal district, who was killed in December last year.
Rohit's elder brother Roshan had filed a petition mentioning the Union of India represented by then Home secretary, Ministry of Home Affairs North Block Central Secretariat, CBI and
state of Manipur represented by secretary/commissioner as respondents.
The petition was heard in the court of Chief Justice Sanjay Kumar on Friday.
According to the petition, Heirok PS registered a case and an SIT was tasked to investigate the case.
The SIT arrested 6 people in connection with the case but the IO could not recover the gun used in committing the crime.
The IO also could not provide supporting evidences linking the six people to the crime and as such, all six were granted bail in March 2022 .
Thus, the petitioner appealed to the Court to hand over the case from the SIT to the CBI to find out the
truth and punish the uilty.
Meanwhile, as per the affidavit filed by the state deputy secretary (Home), the SIT thoroughly investigated the case, including searching many suspected residences but the weapon could not be recovered.
The affidavit, however, did not mention if there was any need to hand over the case to the CBI but only stated that the deputy secretary had no opinion to offer on the matter.
Although
the case FIR mentioned six accused people, one of whom happens to be the younger brother of the MLA of Heirok, the number of accused could be much higher.
After listening to the appeal of the petitioner, the Court directed the case be handed over to the CBI to ensure the family gets justice and the guilty person(s) are punished according to the law.
It further directed the state authority to hand over all relevant documents of the case to the CBI and for the state police to cooperate with the investigation.
The CBI must complete the investigation of the case withing six months.
