Court convicts killer

Maibam Manojkumar, Session Judge Imphal West, convicted Khulem Jiten (41) s/o Kh Kendrajit of Naoremthong Khulem Leikai, under section 302 IPC (Murder), section 307 IPC (Attempt to murder) and under 2 7 Arms Act, for killing one of his uncles and injuring another, and fixed September 20 for the sentence hearing and the announcement of quantum of punishment against the convict.
The order was announced in an open Court yesterday after the order of the trial case was kept reserved on August 29 (the day of the final argument hearing of the case).
During yesterday's hearing, Khulem Jiten was produced before the Session Court Imphal West from Sajiwa Central Jail.
A few of the victim's family members were allowed to enter the Court complex.
During the hearing yesterday, the Court heard the submission of A Nilachandra, APP of the State and Advocate H Kenajit, defense counsel of the convict at length.
The APP submitted before the Court that the trial case relates to the murder of one of the convict's uncle Kh Krishnamohan whom Jiten shot with a DBBL gun and the attempt to murder another uncle Kh Priyobarta whom he shot with a .32 pistol on June 30, 2015 .
The APP continued that some of the 20 prosecution witnesses who were examined, are eye witnesses of the incident and cited some cases.
On the other hand, the defense counsel of Khullem Jiten submitted that the incident happened while Jiten tried to protect his wife and his mother and in support of the submission he cited some case laws as well.
After hearing both sides, the Court came to the conclusion that the contradictions submitted by the defense counsel are all minor discrepancies which are not related to the core issues/points of the incident and cannot be a ground to reject the evidences.
As a result of the discussions, reasons and observations during the trial, the Court came to the conclusion that the convict attempted to murder his uncle Khulem Priyobarta by shooting him with his pistol and murdered Khulem Krishnamohan by shooting him with a license DBBL gun.
The Court also mentioned that the convict has hopelessly failed to prove that he shot his victims Kh Priyobarta and Kh Krishnamohan in self defense or to defend his mother or wife and added that the laws cited by the defense counsel are not in the position to help the convict on his plea that he had shot his uncles for his private defense.
Accordingly the Court convicted Khulem Jiten under 302 IPC for murdering his uncle Khulem Krishnamohan and under section 307 for attempting to murder his uncle Khulem Priyobarta.
The Court also convicted Jiten under section 27 Arms Act for using a licensed pistol and a DBBL gun in contravention of provision of section 5 of Arms Act and its rule and fixed September 20 for the sentence hearing.
It may be mentioned that during the trial, the convict was out on bail and was staying at the parental home of his wife at Top Khongnangkhong when he killed another uncle on July 27 this year at Meitei Langol Punsi Leikai.
During the police interrogation in connection with second murder case, Khulem Jiten revealed that he had been planning to take revenge against the new victim (L) Kh Tomba (who also happened to be a prosecution witness of the trial case against him) for not allowing him to enter and live at his residence at Naoremthong Khullem Leikai after the first incident in which he killed one of his uncles and injured another.
