Rape accused remanded to police custody

An 18 year old youth accused of raping a 50 year old woman has been remanded to police custody for seven days till October 26 by Judicial Magistrate First Class (JMIC), Imphal West 1 .
The alleged accused Brahamcharimayum Hemantakumar alias Gulu Sharma 18 s/o B Haridas of Singjamei was pulled up by a team of Singjamei police station from Observation Home, Takyel after the alleged accused surrendered before the Court on October 14 claiming himself as a minor.
The alleged accused was produced before JMIC Imphal West Court by a team of Singjamei police station under section 376 IPC.
Police prayed that the accused be remanded to police custody for eight days for thorough investigation of the case.
It was submitted before the Court that on September 30, the victim who is a neighbor of the alleged accused lodged a written complaint at Singjamei police station.
According to the complaint, the woman woke up at around midnight of September 26 as she felt something inserted in her private part.
She found the alleged accused sitting naked on her bed and she shouted in shock.
She also slapped the alleged accused 2/3 times.
Even as the victim's cousin (brother) rushed into her room on hearing her shouts, the alleged accused ran away taking advantage of darkness.
Medical examination of the victim was conducted on October 1 at RIMS Forensic Science laboratory.
The victim gave her statement before the Court on October 14 and the alleged accused surrendered before the JMIC Imphal West 1 on the same day stating he was a minor.
Subsequently, the Court sent the alleged accused to the Observation Home, Takyel the same day.
It was also submitted that the alleged accused was a married person and having two children and the age of the alleged accused as per the Board and school record on the date of occurrence of the alleged crime was 18 years, 8 months and 4 days.
The alleged accused admitted that he went to the house of the victim September 26 at around 11.30 pm through the back door.
After hearing the submission of the APP, the Court remanded the alleged accused to police custody for seven days till October 26 .
