Myanmarese sentenced

Chief Judicial Magistrate Imphal West Lamkhanpau Tonsing today sentenced a 34 year old Myanmar National Sai Tun Win to one year simple imprisonment along with a fine for offences under
the Foreigners Act 1946 .
Sai Tun Win s/o Uyi Sar of Muse, Myanmar was arrested in August last year while trying to board a flight from the Tulihal airpot using a fake driving license.
The sentence was announced today in an open Court after the sentence hearing of the case against the accused Sai Tun Win under section 420, 468 and 471 of the Indian Penal Code.
During the sentence hearing defense counsel of the Myanmar National prayed for leniency saying there is no intention on the part of the accused to commit the offence and it was his first.
The Court found the accused guilty of staying beyond the period of Visa which is an offence under the Foreigners Act.
The Court further said that the accused was in possession of a fake driving license in the name of one Khaituang and used it to board a passenger flight from the Tulihal International Airport.
The Court stated that however there is no evidence to show that the accused made the fake driving license himself.
In fact it appeared that the accused innocently tried to use the fake license to obtain passage in a flight out of the State.
The Court directed prosecution to take up necessary actions to deport the accused/convict on the expiry of the sentence through Home Department, Government of India.
