To disqualify PSs Cong files case at HC

Two Congress MLAs have filed writ petition before the High Court of Manipur against the Manipur Legislative Assembly to quash and set aside the impugned Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Act 2012.According to a reliable source, the writ petition was filed by MLA of Wangkhem Assembly Constituency K Meghachandra and MLA of Wabagai Assembly Constituency Fajur Rahim, through their respective counsels for the disqualification of the Parliamentary Secretaries of the State Legislative Assembly and to quash and set aside the impugned Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Act 2012 .
The writ petition filed by the two Congress MLAs is likely to be heard before the Court of Acting Chief Justice N Kotiswar Singh on February 5 .
On the other hand, the PIL filed by RK Joysana through his counsel Advocate Hemchand, was listed for hearing on February 6 .
It may be mentioned that the said PIL, filed in connection with the appointment of 12 Parliamentary Secretaries by the BJP led coalition Government, against the State Government represented by Chief Secretary, Secretary of Manipur Legislative Assembly, Principal Secretary/Commissioner/Secretary (Finance), Secretary to Chief Minister, CM Secretariat and Secretary (Law) as official respondents, was listed by High Court of Manipur in May last year.
The PIL prayed for quashing and setting aside the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Act 2012 and also prayed for issuing directions to the respondents to quash and set aside the impugned notification of March 24, last year, regarding the allocation of portfolio/Departments.
The PIL questioned the legislative competency and the Constitutional validity of the said Act.
It may also be mentioned that Manipur Pradesh Congress Committee (MPCC) president TN Haokip stated during a press conference on January 29, that the Congress party will approach the Court if the Governor fails to take up necessary actions against the appointment of the 12 Parliamentary Secretaries by the BJP led coalition Government even after the submission of a second reminder.
