Maibam Manojkumar, Special Judge, POCSO Imphal East, today, convicted one Yumnam Naocha under POCSO Act for sexually assaulting a minor in November of 2016, apart from fixing November 29 for the sentence hearing.
The judgment was announced today after it was kept reserved on October 11 following the final hearing against the convict, Yumnam Naocha (24) s/o Y Ranjit of Pukhao Khabam.
The case began from November 9, 2016 onwards after a complaint was lodged by the father of the minor victim stating that his (three and half year old at the time) daughter was sexually assaulted by the convict in the morning of November 5 taking advantage of the lack of people in the house (the family members were attending the last rites of his wife's grandmother) .
The incident came to light that night when the minor complained about pain in her abdomen.
The family took the minor to a nearby hospital after her mother spotted some blood stains in her pants and at the hospital, the doctor had expressed suspicion of sexual assault.
Based on the complaint, a regular case under POCSO was registered and the convict was arrested on November 9 (2016) The Investigating Officer of the case, Women Sub Inspector RK Babina Devi submitted the charge before the Court under section 6 of POCSO Act in mid 2017 for the necessary trial.
During the trial, a number of witnesses from the prosecution side, including the victim's father (complainant), the victim, the IO of the case and forensic doctors gave their statements as prosecution witnesses while the defense counsel of the convict also produced some defense witnesses.
The Court, after hearing both sides and after going through the case records, convicted Yumnam Naocha under POCSO Act and fixed November 29 for the sentence hearing.
