Court rejects bail plea

The Court of Chief Judicial Magistrate, Imphal West Court today rejected the bail application filed by the two alleged accused 1st IRB personnel and they have been remanded to judicial custody till November 8 .
Two alleged accused IRB personnel identified as Huirem Ingoba (42) s/o H Pheijao of Naharup Pangong Makhong and Soraisham Surchandra (45) s/o S Kulla of Yairipok Kekru Leikai were produced before the Court in connection with the loss of two service weapons (Insas rifles) along with magazines, ammunition and a wireless set from Kangla Northern Gate post on October 14 .
The accused submitted before the Court that the weapons (Insas rifles) and the ammunition were stolen while they were asleep and had no hands in their disappearance.
The Court order mentioned that the service weapons in the custody of the accused persons and went missing from their post between October 14 and October 15 and whereabouts of the weapons are not known till today.
Defence counsel of accused S Surchandra submitted before the Court his client was seriously ill and due to his illness he was unable to perform his duty and so went to sleep though he was supposed to be on duty and during those period, the weapons and arms disappeared.
Hence he prayed for leniency and bail.
In support of his submission a medical treatment report of his client was submitted before the Court.
After hearing the submission of the APP and defence counsels and the accused, the Court passed an order stating that the service weapons with ammunition were lost while in the custody of the two accused.
Even though the dishonest intention required under section 409 is not yet established, there are areas which require further investigation, it ruled.
The Court then rejected the bail application and the two accused were remanded to judicial custody till November 8 in the interest of the ongoing investigation.
