10 years RI for rape convict

Salam Imocha, Session Judge Thoubal, has sentenced a.34 year old former Zilla Parishad member of Sikhong Sekmai Nagar Panchayat, Kangabam Boby to 10 years rigorous imprisonment along with a fine of Rs 50,000 for rape and criminal intimidation.
The judgement order had been kept reserved till today, after the final argument hearing of the case was held on April 13 and 17.The trial against the convict, Kangambam Boby 34 (L) K Dhananjoy of Lourembam Aripat, Yairipok began from 2014, after the victim of the case lodged a complaint to Chief Judicial Magistrate (CJM) Thoubal, which was forwarded by CJM Thoubal to OC, Thoubal PS.
The complaint stated that on July 19, 2014, at around 10.30 am, the victim/complainant went to the house of her aunty at Kakching Khunou.
When she reached Yairipok Lamkhai, she met the convict who asked about her details and later forcibly took her inside a fast food restaurant located at Thoubal Mela ground and raped her.
After the completion of the investigation, the IO of the case, SI of Thoubal PS, RK Geetasana, submitted charge sheet before the Court and on the basis of the charge sheet and the enclosed documents, charges under section 376 and 506 IPC were framed against the convict on June 29, 2015.During the trial of the case, the Court recorded the statement of 12 prosecution witnesses and examined 10 documents related to the case.
However, the convict did not produce any defense witness.
The Court after hearing the submission of Aribam Gopendro Sharma, Additional PP as well as the defense counsel of the convict, came to the conclusion that as per the evidence, the victim met the convict on July 29 , 2014 on a passenger vehicle on the way to Yairipok Lamkhai.
Under coercion, she was taken to the fast food restaurant at Thoubal Mela ground and raped by the convict, which is supported by prosecution witnesses of the case.
The Court order further stated that it is also proven in the medical report that the victim has been raped and there is also evidence that on July 27, the convict had demanded the victim to meet him threatening that he would disclose all about the incident if she did not agree and at the meeting, the convict forcibly fondled the victim.
The Court decided that the prosecution successfully proved and established the charges against the convict beyond reasonable doubt and hence the former Zilla Parishad member was convicted under section 376 and 506 and the Court fixed sentence hearing today itself.
The Court also slapped a fine of Rs 50,000 on the convict.
In case of default of payment of the fine, the convict has to undergo simple imprisonment for 3 months, ruled the Court.
The Court also sentenced the convict to rigorous imprisonment for 2 years for the offence under section 506 IPC (criminal intimidation) and informed that both the sentences are to run concurrently.
It ordered a sum of Rs 25,000 thousand out of the fine imposed, to be paid to the victim as compensation under 357 CrPC.
