Forger's bail plea rejected

Imphal, November 25 2021: The Chief Judicial Magistrate, Imphal West today rejected a bail application filed by an accused lodged in judicial custody for allegedly making fake Aadhaar cards for Myanmar Nationals.

During today's hearing which was held via video conference, the Counsel of the accused denied all the allegations made against the accused person, Rejoice Milun Zou alias Mang-khalien (40) of New Zou Veng, Churachandpur.

The Counsel submitted the Court that the allegations are all concocted stories with no sufficient evidence.

The accused is quite innocent of the charges leveled by the police and there is not a single iota of evidence to substantiate the prosecution story, the Counsel submitted.

The Counsel also submitted that the accused has no prime intention to make a fake Aadhaar Card for his own profit but he was under heavy pressure from one Chingngaihdim, who is a co-accused of the case, and Rejoice Milun Zou was arrested for the first time of his life.

The Counsel further submitted that the accused was a private teacher at Chinkham Modern High School, Zomi Colony, Churachandpur and a married person having three minor daughters and one son.

He is the only sole bread earner of his family and as such his entire family members shall suffer a great hardship if he is kept confined in judicial custody, the Counsel submitted and prayed the Court to release the accused on bail.

The APP for the State, on the other hand, objecting to the bail prayer of the accused/petitioner, submitted that the accused was arrested on the disclosure of the co-accused, Chingngaihdim that he was involved in making fake Aadhaar card for Myanmar Nationals to let them enter India illegally.

The APP also submitted that the accused received monetary benefits for forging Aadhaar cards.

He took photos of the Myanmar Nationals, received the details of them and in a matter of minutes and prepare fake Aadhaar card for Rs 300 (Rupees three hundred) per Aadhaar card, said the APP and prayed the Court to reject the bail prayer of the accused as prima facie evidence has been established against him.

On perusal of the materials on record, the Court observed that no subsequent development exists which could be put into consideration for letting the accused out on bail.

The Court also observed that the accused may also have been involved in other cases of forging of Aadhar card and opined that a thorough investigation is required to determine the extent to which Aadhar cards are forged and who else are in collusion with him.

Letting him out on bail at this stage of investigation will not be proper considering the witnesses and evidences, the Court observed and rejected the bail prayer.
