The Gauhati High Court, Principal Seat has today fixed October 5 for hearing the writ petition filed by AR authorities challenging the legal validity of instituting the ongoing Thangjam Manorama Death Inquiry Commission by the State Government.
A reliable source reaching here said that Government Advocate (High Court) Th Ibohal appearing for the State, submitted the counter affidavit before the Court.
Following the plea of the lawyer on behalf of Assam Rifles, the Court headed by Justice PG Agarwal fixed the matter for hearing on October 5.The writ primarily challenges the legal validity of setting up the Commission of Inquiry by the State Government contending that the latter has no right at all to do so.
It is pertinent to mention here that the Court, acting on the same writ, had ordered to shift the ongoing State sponsored inquiry panel headed by C Upendra, retired judge at the premises of Imphal Central Jail in-camera.
