Shift Meghen to Tihar plea quashed

Rejecting a petition, a special Court of the National Investigation Agency (NIA) has quashed a plea to transfer UNLF chairman RK Meghen alias Sanayaima from Gauhati Jail to Tihar Jail, New Delhi.
Superintendent of Gauhati Jail, who received a letter from Ministry of Home Affairs, Government of India on July 26 in connection with transfer of RK Meghen to Tihar Jail, filed a petition in the NIA Court, which was immeidately objected to by the counsel of the arrested rebel leader.
After two rounds of hearing over the petition, the NIA Court gave its final judgement today over ruling the petition, M Gunadhor, counsel of RK Meghen, has conveyed.
During the course of the hearing over the petition, NIA counsel DK Das contended that the UNLF Chairman still continue to operate from within the jail and his transfer from Gauhati Jail to Tihar may reduce influence over witnesses.

However, counsel of Meghen M Gunadhor argued that apart from Jail being a State subject, transfer of an under-trial prisoner (UTP) from one State to another State is not in conformity with Transfer of Prisoners' Act, 1950 .
Quoting remarks in Jail Manual wherein Meghen has been described as very disciplined inside the jail and not involved in any untoward incident and also very composed while being produced in the Court, Gunadhor strongly contested against the petition for transfer of Meghen from Gauhati Jail to Tihar Jail.
Rejecting the petition , Special Judge of the NIA court AK Das observed that transfer of Meghen to Tihar Jail is against the law and nothing have been substantiated to prove the charges of wrong doings by Meghen.
