Freed after 12 years

The Court of Session Judge Imphal West on Saturday discharged Ningombam Ibomcha who was in judicial custody for over 12 years as valid prosecution sanctions were not filed against him by the Home Department.
The order was passed after hearing of the charges levelled against Ningombam Ibomcha under Section 302/34 IPC and 27 Arms Act on the death of Rajkumar Sanajaoba on October 20, 2004 .
The case was on against Ningombam Ibomcha, s/o (L) Pishak of Bashikhong Kongba Irong after a complaint was lodged against him by the uncle of the 'victim' before Imphal police station.
The complainant claimed that his nephew Rajkumar Sanajaoba was beaten black and blue by some personnel of Manipur police on October 20, 2004 and one of the personnel shot the 'victim' dead at point blank range.
Reportedly, Ningombam Ibomcha was serving as a Constable at Patsoi police at the time of the incident.
Among others, the defense counsel of Ningombam Ibomcha submitted that the final report of the case was filed after the completion of investigation in a prescribed format along with all details and documents.
They also argued that the Principal Secretary of Home cannot grant prosecution sanction for the offence under Section 27 of Arms Act.
