Rape convict gets life imprisonment

Ch Brajachand, Judge of Fast Track Special Court-II Manipur on Friday sentenced a 28 year old rape convict to rigorous imprisonment for life for murdering a minor after sexual assault in Thoubal on November 9, 2014 .
The man who was convicted on July 5 was produced before the Court for sentence hearing yesterday.
During the sentence hearing, the Court heard submissions of both Special PP A Ashok Sharma and defence counsel of the convict.
The defence counsel submitted that the convict has no other criminal antecedent and he has been languishing in judicial custody for over 7 years during investigation and trial of the case.
The Special PP, on the other hand, argued that the convict is a close relative of the victim and the offence committed by him is gruesome.
The Special PP prayed that extreme punishment be given to the convict.
The Court, after hearing both the parties and on perusal of the material on record, sentenced the convict to undergo rigorous imprisonment of 10 years under Section 6 of POCSO Act for committing penetrative sexual assault and imposed a fine of Rs 5,000.In default of payment of the fine, the convict has to spend another three months under simple imprisonment.
Further, the Court sentenced the convict to undergo rigorous imprisonment for life under Section 302 IPC for 'murder' of the minor and imposed another Rs 5,000 as fine.
Reportedly, the two sentences announced by the Court are to run concurrently.
The Court also asked the State Government to provide Rs 4 lakh as compensation to the family of the victim from the victim compensation fund or any other scheme.
The case was on against the convict after the father of the victim lodged a complaint before Thoubal police station on November 9, 2014 .
