Chamol encounter: NIA re-registers case

Special Court
NIA Manipur today directed
Chief Judicial Magistrate
Chandel to transfer all materials
related to FIR number 3 (11)
2017 to the Court and also
directed the investigation
officer of the case to hand over
case dockets, records, papers,
case dairies, seizure memo and
all seized items along with post
mortem report related to the
case.
The order was passed after
the NIA through a Special
APP filed an application under
section 157 CrPC
intimating the re-registration
of the case at NIA.
The Court registered it as a
Cril Misc case and heard the
special PP who submitted that
on November 15 last year a
road opening party of 4 Assam
Rifles led by Nb Subedar
Santa Bahadur was discriminately
fired upon at
Chamol-Sajik Tampak road
by unknown persons in
which some Assam Rifles
personnel sustained injuries
who were evacuated to
Leimakhong military hospital
for treatment.
He further submitted that
one of the injured persons
Riflemen Jai Prakash Oraon
succumbed to injuries.
He also submitted the
Ministry of Home Affairs'
order issued on March 23 to
NIA Guwahati.
The next day, NIA
Branch office Guwahati reregistered
the case under FIR
number RC 01/2018 NIA
Guwahati under section 121/
121(a) 302/307/326/100 IPC
and r/w 25 (I-C) Arms Act.
After hearing the special
PP, the NIA Court directed
the Chief Judicial Magistrate
Chandel to transfer all case
materials related to FIR
number 3 (11) 2017 to the
Court and also directed the
investigation officer of the
case to hand over case dockets,
records, papers, case
dairies, seizure memo and all
seizure items along with post
mortem report related to the
case.
The Court order further
mentioned that copies of the
order should be sent to CJM
Chandel and OC
Chakpikarong for information
and compliance.
It may be mentioned that
one suspected underground
militant and a personnel of 4
Assam Rifles were killed in
an alleged encounter on early
morning of November 15 last
year at Chamol village near
Indo-Myanmar border, under
Chakpikarong police station,
Chandel district.
It was reported that Assam
Rifles personnel
recovered an AK 47 assault
rifle along with three magazines
and three IEDs from
the encounter site.
