One gets 14 yrs RI for sexual assault

Imphal, November 18 2021:
Special Judge POCSO Churachandpur N Keertichand Singh today sentenced one 41years old man to undergo rigorous imprisonment for 14 years and imposed a fine of Rs 25,000 for allegedly committing a penetrative sexual assault to a minor on October 15, 2016.The accused was convicted by the same Court on November 16 under section 4 of POCSO Act.
The convict was produced before the Court for sentence hearing from Sajiwa Central Jail, today.
During the sentence hearing, Additional PP submitted that the crime committed by the accused is a serious offence and prayed for life imprisonment.
Defence counsel of the convict, on the other hand, contended that the convict has no criminal antecedent and helped the minor in admitting her at District Hospital, Churachandpur.
The defence counsel also said that there is no evidence of bad moral character on the part of the convict and prayed for minimum sentence.
The Court on perusal of all the materials on record and hearing the submission of the Additional PP and defence counsel sentenced the convict to undergo rigorous imprisonment for 14 years and imposed a fine of Rs 25,000.In default of payment of the fine, the accused has to undergo another 3 months of simple imprisonment, the Court ruled.
The fine shall be deposited to the Court forthwith and the said amount has to be given to the victim as compensation.
The Court order also mentioned that the period which the accused has already undergone in judicial custody and trial, if any, will be set off from the sentence awarded.
The Court also recommended providing compensation of Rs 5,00,000 to the victim under the Manipur Victim Compensation Scheme
, 2019 .
