5 and half years RI for sexual assault

RK Memcha, Special Judge, POCSO, Imphal West, today, sentenced one Paul Kamei to rigorous imprisonment for five and a half years, apart from slapping a fine of Rs 10,000 for sexually assaulting a minor victim on September 19, 2017.The convict, of New Selam, Ward No 4 of Tamenglong district, who was convicted by the same Court on September 20, was produced from judicial custody of Manipur Central Jail Sajiwa for the sentence hearing today.
During the proceeding, the Court heard Special PP, A Nilachandra, and the defense counsel, Th Shantikumar.
The Special PP Submitted that Paul Kamei was convicted for committing aggravated sexual assault on the minor victim which is a serious offence and thus prayed to sentence him to 7 years in jail along with the fine.
On the other hand, the defense counsel contended that the convict is a young man and has a chance for rehabilitation to lead a normal life and prayed for awarding him the minimum sentence and to set off the period he had already undergone in the jail from the sentence.
The counsel also submitted that the convict had suffered a fracture on his right leg for which a steel rod was placed inside his leg thus needing proper medical attention and prayed for leniency.
After hearing both sides and going through the materials on record, the Judge sentenced Paul Kamei to undergo rigorous imprisonment for a period of five and half years and slapped a fine of Rs 10,000 on him.
The Court also ruled that the period which the convict already underwent in judicial custody during the period of investigation as well as during the trial, will be set off from the sentence announced.
