Referring to the statement made by the Chief Minister with regard to the re-imposition of Disturb Area Act in Nagaland by the Centre after it was lifted by the Nagaland Cabinet on two occasions, MLA L Ibomcha Singh today categorically stated that the Central Govt does not have the power to re-impose the Disturbed Area Act in any State if the decision to lift the Act is taken by a resolution passed by the House and later approved by the Cabinet for its implementation.
Ibomcha however added that the State Govt should issue the Assembly's resolution for the removal of Disturbed Area Act under section III of AFSP after clearly mentioning the details about the Assembly's resolution.
The Central Govt will have no authority to re-impose it once the Act is lifted by the State Cabinet after the approval of the House, said Ibomcha adding that the State Govt in doing so will also be abiding by the rules laid in the Parliamentary system of Govt.Recalling the two instances in Nagaland when the DAA was re-imposed by the Central Govt after having it was revoked, Ibomcha said that the Central Govt was able to re-impose the Act in Nagaland as no Assembly resolution was passed by the Nagaland Govt before lifting the act from the State.
Referring to the judgement order passed by the Supreme Court on Nov 27 1997 in the Naga People's Movement of Human Right Vs Union of India, he said that para 79 (9) of the order clearly states that State Govt should give prior information and hold discussion with the Central Govt if any state Govt wants to lift the disturb area status.
He also informed that all preparation for launching a non cooperation movement in the State have already been completed and will be launched very soon if the State Govt continues to remain indifferent to this sensitive issue.
The non cooperation movement will include non payment of all form of taxes, added Ibomcha.
Commenting on the death of an elderly man identified as Elangbam Surja while trying to rush home after the sudden announcement of curfew, Ibomcha said the Chief Minister should be directly held responsible for his death.
