Imphal, December 06 2018:
Division Bench, High Court of Manipur, on December 4, heard the Cril appeal case filed by Sapam Charubala Haokip, wife of MLA Yamthong Haokip, against NIA and two others, challenging the bail rejection order which was passed by the Special Court, NIA in October.
The hearing was held in connection with the appeal filed by the petitioner before the Court of Chief Justice Ramalingam Sudhakar and Justice Lanusungkum Jamir of High Court of Manipur.
As per the direction of the High Court, the SP of Manipur Central Jail Sajiwa, personally appeared before the Court and submitted that as per the direction of the High Court, medical evaluation of the MLA has been done at JNIMS.
The Division Beach observed that the medical reports signed by the Medical Superintendent JNIMS, Professor and HOD of Medicine, JNIMS and Senior Resident Department of Medicine JNIMS, gave a clear picture about the present condition of MLA Yamthong Haokip (who is now in judicial custody) and the Bench also observed that the reports also suggested as to how further treatment is to be undertaken as well as the precautionary steps to be taken if the patient is shifted to AIIMS.
In this regard, the SP Manipur Central Jail, Sajiwa, and the Advocate General stated that for providing air ambulance, certain special measures have to be taken and as such some more time will be required but, in the meantime, MLA's medical treatment will continue at JNIMS.
The AG also produced a copy of the State Government's order of November 6 which permitted some personnel to accompany the MLA to New Delhi for treatment.
On the other hand, the counsel of the petitioner stated that he will take the instruction with regards to movement of the MLA from Imphal to Delhi in the air ambulance.
It may be mentioned that Special Court NIA, on November 6, rejected the bail application filed by Saikul MLA Yamthong Haokip but permitted him to get treatment at the Cardio-Thoracic Centre, AIIMS, New Delhi and also directed the SP Central Jail Sajiwa, to make arrangements to provide necessary personnel for escorting the MLA to the said destination.
