Imphal, January 05 2012:
Overruling a writ petition for quashing the results of Manipur Civil Services Combined Competitive (Preliminary) Examination, 2012 declared on September 24, 2011, an order of the Gauhati High Court, Imphal Bench today has directed the Manipur Public Service Commission (MPSC) to constitute an expert committee to re-determine the correct answers in respect of four questions with alleged wrong key answers.
The order has been passed as reserved judgement by Justice N Kotiswar Singh of Gauhati High Court, Imphal Bench today after the writ petition filed jointly by 11 candidates, who appeared in the Manipur Civil Services Combined Competitive (Preliminary) Examination, 2011 conducted by MPSC, was heard on December 3, 2011 .
The petitioners alleged numerous discrepancies in the conduct of the examination right from setting the questions.
The order further observed that 'upon re-determination of the correct answers in respect of the four questions, if any of the key answer is corrected/changed, MPSC would re-evaluate the answer scripts of the 11 writ petitioners only so as to ascertain if any of the petitioners had given correct answers to the four questions in the light of the review answer key and re-assess the marks of the petitioners' .
Moreover, ' if any of the petitioners, upon such reassessment, obtains marks within the cut off marks in their respective categories, he/they shall be deemed to have been qualified for appearing in the Manipur Civil Services Combined Competitive (Mains), Examination, 2010' .
The court directed MPSC to publish the results of the reassessment exercise in respect of the 11 petitioners at the earliest, preferably within a period of three weeks and provisionally allow the petitioners to appear in the Mains examination scheduled to be held on January 10, 2012 .
However, their results in the Mains examination will be declared only after it is ascertained that they or any one of them have/has qualified to appear in the Mains examination.
If any of the petitioners is not found to be qualified after re-assessment, their results in the Mains examination would not be declared or acted upon, the court order said, and made it clear that the directives will be confined only to the 11 petitioners and will not be extended to any other persons.
