WITH A direction to CBI to expedite the investigaation and deliver justice to the case, the petition case related with the gruesome murrder SDO, Dr Kishan of Kaasom Khullen and his two staff in the court of the diviision bench of the Guhawati High Court, Imphal Bench has been disposed of today.
In the hearing of the writ petition which has been filed in the form of Public Interest Litigation alleging inaction on the part of the respondent in respect of the abduction and brutal and gruesome killing of Dr.Thingnam Kishan Singh, MCS, SDO, Kasom Khulllen along with his two staff Y Token (mandoI) and A Rajen (driver) "by some members of the proscribed organization, NSCN(IM) and praying manily for diirecting the concerned reespondents for in;vestigation of the crime was conducted in the court comprising Jusstice Maibam Binoykumar and Justice AC Uphadyay today.
After hearing the arguuments from counsels ofboth sides, the court directed the CBI to expedite the two casses as far a possible in acccordimce with the relevant law and that the other respondents also to extend all the possible assistance in the investigation of the said two cases in accordance with the relevant law.
Mention may be made that Manipur government entrusted for investigation into the two cases registered with the Ukhrul police station where the jurisdiction of abduction lies and Senapati police station where the dead bodies were found.
"A fair, honest and expeditious investigation into every reasonable accusation against each and every person reasonably suspected of involvement in the said offences has been made strictly in accordance with law.
This writ petition stands disposed of," the court directed.
In the case M Hemchandra appeared as counsel on behalf on the petitioners while Th Ibohal senior government advocate appeared on behalf of the state respondents and C Komol on behalf of the CBI.
Ukhrul police where the three government employees were reportedly abducted before murder registered a regular FIR case (no.8(2)09 Ukhrul PS under section 365/368/34/120-B/212 IPC 19/20 UA(P) A Act and 25 (1-C) A) was registered on receipt of the information of missing of the three.
While another case with the same incident was registered with the Senapati police station where the spot where the dead bodies were recovered cover under FIR no.3(2)09 under section 302/400 IPC as suo moto case.
During the course of investigation into the case taken up as sou motto case with Ukhrul police station, eight persons including five co-accused persons were arrested apart from seizure of two vehicles involved in the case.
Four of the eight have been remanded in the judicial custody.
The official vehicle allotted to the SDO, went missing, has also been retrieved and as many 28 persons have been examined and their statements have also been recorded under section 161 CRPC.
"From the statement of the witnesses the involvement of NSCN (IM) cadres is the case is well established," a source quoting the police investigation report disclosed adding thar hectic efforts have been made by the investigating officer (IO) of the case to arrest the main culprits by conducting raids at various places.
It also mentioned that there was no action on the part of the law enforcing agencies in the aftermath of the abduction and the "gruesome and brutal killing" of the three innocent civilians by NSCN(IM).
Even though, IO made effort to examine the DC, Ukhrul Pankaj Kumar Pal but he was not found at the moment.
But his involvement in the case relating to abduction and killing of the Dr Thingnam Kishan, SDO Kasom Khullen and his two subordinate staff is yet not established.
No formal complaint was lodged from any side with regard to the abduction of the SDO-Kasom Khullen and his staff but it has been established that they were abducted from Naga Gate, Hundung and not from the premise of the DC-Ukhrul DC office.
