Imphal, October 26 2009:
State police could not submit its affidavit to the One-man Judicial Enquiry Commission led by Justice (retired) PG Agarwal on the July 23 shooting incident at Khwairamband Bazar eventhough commission asked to submit on or before October 21 .
The commission, in one of its orders issued on October 9 last asked the state police to submit its affidavit regarding the shooting incident that claimed life of two persons and injured to five others within October 21 but the same is yet to submit from the police side, official sources said today.
Mention may be made that while admitting the request of the police department to give more time with regard to the submission of the affidavit, the commission order to submit the same on or before 21 October fixing the next hearing on October 27 (tomorrow) .
The Commission asked both the SPs of Imphal east and west to submit their explanations for their failure to submit their reports during the seating held on October 9 with regard to issue summons to them to appear in person on the next date of hearing.
Imphal West District Magistrate also to ask to furnish the report of the magisterial enquiry report into the death of Ch Sanjit and Th Rabina conducted under the Criminal Procedure Code.
But, source said that the district magistrate has intimated the commission that the magisterial enquiry has been suspended by an order of the state home department.
The commission has received the post mortem and medico legal reports of the victims of the July 23 incident but the intimation to the state government for appointment of a counsel of the commission is yet to translate into action.
With the regions behind, there may have some hindrance in the hearing into the case which the commission fixed tomorrow at 10.30 pm.
